MNR RESPONSE TO OOS

HI ALL


HERE the response i got frome the mnr yesterday on the tread ,,,out oss season and out off size fish.......

the exact word from there e-mail.



IF an angler accidentally catches a fish out of season or within the size limit where there is a restriction on the size for that species, the angler HAS to release the fish IMMEDIATELY, which means they are NOT supose to take a picture of the fish....



that was there response to my e mail,,,,,,the response come frome,,,natural ressource informatio centre peterborough on,



so,,,,,,,,,,,,the IMMEDIATELY,,,,,,and NOT SUPOSE,,,,,,,,,

that those look to me,that bothe fish have to be back as soon as possible,,,,,,,,,and one is NOT better then the other one,,,to take a picture...

anyway,that was there response,,,,,,

If they had a very strong opinion on it it would be clearly stated in the regs. What they have done instead is used the word "IMMEDIATELY" which allows co's to use their discression when enforcing.

Don't forget all laws are open to some interpretation. If it's obvious that the person is intended to break the law then the co will press charges...

How many people get let off with a warning when caught speeding... you broke the law but you didn't get a fine.

Maybe we need to bug the mrn some more so they finally introduce a no camera in the boat reg :roll: gezzzzzzzzz

ask them the same question off the phone,,,,,one c.o. and is boss.....

that there answer,,,,,,,,

YOU ARE '' NOT '' ALLOW TO TAKE A PICTURE OFF AN OUT OFF SEASON FISH OR AN OUT OFF SIZE LIMIT FISH SPECIES( WHERE ITS REGULATED),,,,

IF YOU DO EVER TAKE A PICTURE OFF BOTH OOS FISH,,,,,,,YOU COULD BE CHARGE OFF RETAINING A FISH( EVEN FOR A BREAF MOMENT),,,,SO THE C.O COULD CHARGE YOU.


SO I ASK IS IT LEGAL OR NOT...................RESPONSE,,,,,,,,,

NOT LEGAL FOR BOTH CASE.........

they do have strong opinion,,,,,but like you said john its not clear in the regulation,,,,,,,, :?

I guess I'll be goin to the crowbar hotel cause I'm pretty sure if I catch a 53" musky in the future you can bet there will be a picture

There are 10 ways of asking the question and you can get multiple answers for each one.

I bet taking pictures of OOS fish is ilegal but I know you can take a picture of your muskie if undersized or fishing with a conversation license.

Maybe we need to push our MNR representatives to set a guideline to be included with the new regulations coming up in 2007.

I looked up the word "immediately" in my dictionary - the Canadian Oxford Dictionary (provided for reference only).

immediately = instantly, without pause or delay

IMHO, that's distinctly clear. If there's a better word, lets have it and send it to MNR for inclusion.

I concur that on many occasions, the same question receives varied responses from different MNR reps. As well, existing fishing regulations are not totally clear.

However, even if all COs and other MNR reps provided identical rersponses to all questions and even if the new enhanced Ontario fishing regulations (due in 2007) were perfect and completely understandable, many will still rationalize why they won't comply with responses received or the new regulations. That's not intended as a criticism but rather an acceptance of reality, unfortunate as it may be.
